13.10.140: INDIRECT DISCHARGE PERMIT:
   A.   No significant industrial user shall discharge wastewater into the POTW without first obtaining an indirect discharge permit. Significant connecting users may require an indirect discharge permit in order to discharge wastewater into the POTW.
   B.   Any violation of the terms and conditions of an indirect discharge permit shall be deemed a violation of this chapter and subjects the user or permittee to the sanctions set out in this chapter. Obtaining an indirect discharge permit does not relieve a permittee of its obligation to comply with all federal and state pretreatment standards or requirements or with any other requirements of federal, state and local laws.
   C.   The industrial user who will seek an indirect discharge permit shall be aware of the process involved to modify a permit (Section 13.10.160), application/reapplication requirements (Section 13.10.170) the use of waivers for sampling and the process to seek a waiver (Section 13.10.190), penalties for violation of permit requirements and conditions for termination of a permit (Section 13.10.230)
   D.   The city may deny or condition the new indirect discharge permit for each significant industrial user and to certain significant connecting users for increased contributions of pollutants or conditions that could lead to slug discharges from facilities (Section 13.10.090) which will be based on information in the data disclosure form and include:
      1.   Any fees and charges to be paid upon initial issuance.
      2.   Limits on the average and maximum wastewater pollutant concentrations, loadings or characteristics including Best Management Practices.
      3.   Limits on average and maximum rate and time of discharge or requirements for flow regulations and equalization.
      4.   Self-monitoring requirements, including flow monitoring frequency and method, sampling frequencies, number, types and standards for tests.
      5.   Authorized points of discharge and regulated processes.
      6.   Requirements for installation and maintenance of inspection and sampling facilities.
      7.   Compliance schedules.
      8.   Special conditions as the city may require, such as sampling locations or circumstances of a given discharge.
      9.   Reporting requirements, including, but not limited to, notification of accidental spills, noncompliance and discharge/ process changes (see Section 13.10.230 on recordkeeping).
      10.   Requirements for submission of special technical reports or discharge reports where same differs from those prescribed by this chapter.
      11.   Any special agreements the city chooses to continue or develop between the city and SIU.
      12.   Standard conditions as apply to all significant industrial users and certain significant connecting users.
All permits shall be issued for a maximum five (5) year duration, subject to amendment of revocations provided in this chapter. Under extraordinary circumstances, it may be issued for a stated period or may be stated to expire on a specific date. Indirect discharge permits shall be issued for a specific time period, not to exceed five (5) years. Each permit shall indicate an effective date and an expiration date.
Indirect discharge permits are issued to specific users for a specific operation and are not assignable to another user without the prior written approval of the city or transferable to any other location. Indirect discharge permits shall be voidable upon cessation of operations or transfer of business ownership. The indirect discharge permit issued to a particular user is void upon the issuance of a new indirect discharge permit to that user. (Ord. 1526 § 8, 2023: Ord. 1056, 1992)
