Whoever violates or fails to comply with any of the provisions of this chapter shall receive no penalty on the first offense. On a second offense and thereafter, for the same premise in a calendar year, such person shall be fined as follows:
(a) Residential alarm response.
(1) A fee of fifty dollars ($50.00) for residential premise false alarms to which the Police Department responds.
(2) A fee of one hundred dollars ($100.00) for residential premise false alarms to which the Fire Department responds.
(b) Non-residential alarm response.
(1) A fee of one hundred dollars ($100.00) for non-residential premise false alarms to which the Police Department responds.
(2) A fee of two hundred fifty dollars ($250.00) for non-residential premises false alarms to which the Fire Department responds.
(c) The user must submit a report to the Director of Public Safety within fifteen days describing the actions taken or to be taken to discover and eliminate the cause of the false alarms.
(d) If the alarm user submits a report as directed, the Director shall determine if the action taken or to be taken will substantially reduce the likelihood of false alarms.
(e) If no report is submitted, or if the Director determines that the action taken or to be taken will not substantially reduce the likelihood of false alarms, the Director shall give notice, by certified mail, to the user that such alarm shall be disconnected and shall not be used until proof is given by the user to the Director that such alarm is repaired or corrected and is not only working properly, but is being properly used.
