Emissions exceeding any of the limits established for any class of equipment as a direct result of irregular conditions or breakdown of any such equipment shall not be deemed to be in violation of such limits, provided the owner or operator immediately advises the Building Commissioner of the circumstances and outlines a corrective program acceptable to the Commissioner, by telephone, messenger or in person and confirms such program to the Commissioner in writing by registered or certified mail within five days after the commencement of the irregular condition or breakdown, and provided further that the Commissioner gives written approval of the preferred corrective program.
If under this section the number of breakdowns of any piece of equipment exceeds three in any six-month period, the Commissioner may require an owner or operator to submit a satisfactory maintenance program for such equipment. Failure to maintain equipment in accordance with such a maintenance program shall be grounds for revocation of a certificate of operation.
