1530.03   DEFINITIONS.
   As used in this chapter:
      (1)   "Air cleaning equipment" means any control equipment which removes, reduces or renders less noxious air contaminants discharged into the atmosphere.
      (2)   "Air contaminants" means any solid, liquid or gas, or any combination thereof, except uncombined water, discharged into the atmosphere.
      (3)   "Air pollution" means the presence in the atmosphere of one or more air contaminants in such quantities for such period of time that they are or may be injurious to human health, plant or animal life or property or the conduct of business.
      (4)   "A.S.M.E." means the American Society of Mechanical Engineers.
      (5)   "A.S.T.M." means the American Society for Testing Materials.
      (6)   "Atmosphere" means the air that envelopes or surrounds the earth.
      (7)   "B.T.U." or "British Thermal Unit" means the amount of heat required to raise one pound of water one degree Fahrenheit.
      (8)   "Control equipment" means any equipment designed to regulate the release of contaminants from process, fuel-burning or refuse-burning equipment by reducing the creation of air contaminants or the emission of air contaminants into the atmosphere or both.
      (9)   "Emission" means the act of releasing an air contaminant into the atmosphere or the material so passed into the atmosphere.
      (10)   "Fuel" means any form of combustible matter - solid, liquid, vapor or gas, but excluding refuse.
      (11)   "Fuel-burning equipment" means any furnace, boiler apparatus, stack and all appurtenances thereto used in the process of burning fuel for the primary purpose of producing heat or power.
      (12)   "Internal combustion engine" means an engine in which combustion of a gaseous, liquid or solid fuel takes place within one or more cylinders.
      (13)   "Mechanically fired apparatus" means a device in which fuel is introduced into the combustion chamber by power-driven mechanical equipment.
      (14)   "Miniature boiler" means a boiler to which the classification "miniature" applies and embraces fired pressure vessels which do not exceed the following limits: sixteen inches inside diameter of shell; forty-two inches overall length of outside to outside heads at center; twenty square feet water heating surface; 100 pounds per square inch gauge maximum allowable working pressure.
      (15)   "Odor" means that property of an air contaminant which affects the sense of smell.
      (16)   "Opacity" means the state of a substance which renders it partially or wholly impervious to the rays of light. Opacity refers to the obscuration of an observer's view.
      (17)   "Open fire" means a fire from which the products of combustion are emitted directly into the open air without passing through a stack or chimney.
      (18)   "Particulate matter" means a material other than uncombined water, which is suspended in or discharged into the atmosphere in a finely divided form as a liquid or solid, at standard conditions.
      (19)   "Person" means any individual, partnership, copartnership, firm, company, corporation, association, joint stock company, trust, estate or any other legal entity, or its or their legal representative, agent or assign.
      (20)   "Process equipment" means any equipment, device or contrivance for changing any materials whatever or for storing or handling of any materials, and all appurtenances thereto, including ducts and stacks, the use of which may cause discharge of an air contaminant into the atmosphere, but not including that equipment specifically defined in this chapter as fuel-burning equipment or refuse-burning equipment.
      (21)   "Process weight" means the total weight of all material introduced into a unit operation or unit process, including solid fuels but excluding liquid fuels and gaseous fuels when these are used solely as fuels and excluding air introduced for purposes of combustion.
      (22)   "Process weight per hour" means a rate established as follows:
         (a)   For continuous or long run steady state unit operation or unit process, the total process weight for the entire period of continuous operation or for a typical portion thereof divided by the number of hours of such period or portion thereof; and
         (b)   For cyclical or batch unit operation or batch process, the total process weight for a period that covers a complete operation or an integral number of cycles, divided by the hours of actual process operation during such period. Where the nature of any process or operation or the design of any equipment is such as to permit more than one interpretation of this definition, the interpretation that results in the minimum value for allowable emission shall apply.
      (23)   "Refuse-burning equipment" means any incinerator, equipment, device or contrivance used for the destruction of garbage or other combustible wastes by burning, and all appurtenances thereto.
      (24)   "Ringelmann Chart" means the Chart published and described in the U.S. Bureau of Mines Information Circular 8333, and on which are illustrated graduated shades of gray to black for use in estimating the light obscurity capacity of smoke.
      (25)   "Seal" means any device, tag or marking installed or affixed by the Building Commissioner or by his agents or representatives so as to prevent use of the process, fuel-burning, refuse-burning or control equipment or premises causing a violation or from which violations of this chapter originate.
      (26)   "Smoke" means small gas-borne particles resulting from incomplete combustion, consisting predominantly, but not exclusively, of carbon, ash and other combustible material.
      (27)   "Stack" means a duct, chimney, flue, conduit, vent or opening designed or arranged for the emission of air contaminants into the atmosphere.
      (28)   "Standard conditions" means a gas temperature of sixty degrees Fahrenheit and a gas pressure of fourteen and seven-tenths pounds per square inch absolute dry air.
