1529.16   DRIVEWAYS AND DRIVEWAY APRONS.
   (a)   Any contractor, builder or homeowner who constructs a driveway for any home or commercial or industrial facility in the City shall provide for clearance of at least four feet from any fire hydrant and/or public utility installation on the tree lawn. If an existing fire hydrant and/or public utility installation is closer than four feet, the same shall be moved to the required distance at the expense of the contractor, builder or homeowner, and the same shall be moved by the City upon the deposit with the Director of Public Service of the sum required to cover the entire cost of such movement. If it is to be moved by others, written approval of the Director shall be required. This applies to new installations only, not to replacement of existing driveways and driveway aprons. The driveway apron is considered part of the driveway and shall be of concrete except as stated in subsection (b) hereof.

   (b)   When the driveway apron that is to be constructed or replaced is located on a street where there are no curbs or gutters, installation of a driveway culvert apron pipe is required if determined by the City Engineer. The elevation, size and type of material shall be approved by the City Engineer. This pipe shall extend a minimum of four feet beyond each edge of the driveway apron. Paving material for this type of driveway apron shall be asphalt. Concrete can be used where the existing driveway apron being replaced is concrete.

   (c)   All driveway aprons shall be constructed of concrete in accordance with the requirements of Chapter 1512 except those described in subsection (b) hereof.

   (d)   A permit shall be required for the replacement and repair of driveways, driveway aprons or sidewalks.
      (1)   Concrete driveways, aprons and sidewalks shall be installed with all new residential structures.
      (2)   When replacing or repairing existing concrete driveways, aprons or sidewalks, the replacement shall be of concrete.
      (3)   When replacing or repairing existing asphalt driveways, aprons (as applied to subsection (b) hereof) or sidewalks, replacement shall be of asphalt, unless the homeowner chooses to upgrade to concrete.
      (4)   In extreme cases where the length of the driveway, not including the apron, exceeds the normal residential span of seventy-five feet, substitution for concrete may be made with the approval of the Building Commissioner.

   (e)   No driveway shall be constructed in a new subdivision within six feet of any catch basin, and no driveway apron shall be constructed so as to incorporate a sewer manhole.
   (f)   No permit for occupancy of such premises shall be granted until the provisions of this section are complied with.
