1507.04   EMERGENCY PRECAUTIONS; AUTHORITY OF BUILDING COMMISSIONER.
   If the person whose duty it is to preserve or protect any wall or structure from injury neglects or fails to do so, after having received the notice required under Section 1507.02(f) and an additional notice to do so, given forty-eight hours prior to the time work is scheduled to commence, from the Building Commissioner, then the Commissioner may enter upon the premises, employ such labor, furnish such materials and take such steps as in his judgment may be necessary to make the same safe and secure or to prevent the same from becoming unsafe or dangerous, at the expense of the person whose duty it is to keep the same safe and secure. Any party doing the work, or any part thereof, under and by direction of the Commissioner may bring and maintain an action against the person whose duty it is to protect such wall or structure, to recover the value of the work done and materials furnished in and about the premises, in the same manner as if he had been employed to do the work by such person.
