(a) The Building Commissioner may issue a partial occupancy permit in order to allow the occupancy of a portion of the structure prior to the completion of work in the remainder of the structure or due to uncertain weather factors during certain times of the year which prevent proper grading of lots and other exterior work from being completed.
(b) When, because of uncertain weather factors during certain times of the year, property grading of lots and other exterior work cannot be completed, a cash bond shall, in lieu of the required grading and other completion, be deposited with the Building Commissioner by the contractor, builder or developer so requesting an occupancy permit. Such bond shall be in the amount of five hundred dollars ($500.00) or ten dollars ($10.00) for each front foot, whichever is greater, for a single or two-family dwelling, and in the amount of one thousand dollars ($1,000) or twenty dollars ($20.00) for each front foot, whichever is greater, for any other building, and shall be posted prior to occupancy.
(c) A temporary occupancy permit for a one, two and three-family dwelling may be issued upon payment of the fee prescribed in Chapter 185 of the Administrative Code to permit occupancy of such dwelling or unit until all required work is completed for an occupancy permit.
(d) In addition to the cash bond for grading or partial occupancy, an affidavit of the contractor, owner or tenant to guarantee proper completion, including compliance with the approved grading and/or building plans, shall be deposited with the Building Commissioner.
(e) Whenever a cash bond and affidavit are deposited with the City in lieu of grade completion prior to occupancy, such grading shall be completed in accordance with the approved grading plan no later than fifteen calendar days from the date of the written notice from the Commissioner directing the completion of the grading in accordance with the grading plan. Upon failure to comply with the notice from the Commissioner, the City shall complete the work and cause the lot to be graded and shall pay, from the cash bond posted, all costs incurred. Any balance remaining from the bond posted shall be returned to the person who posted the bond. Any costs exceeding the amount of the bond shall be chargeable to the person who posted the bond.
(f) It is further required that the owner of any dwelling or building designed for occupancy shall, upon having such dwelling or building enclosed, post conspicuously at the entranceway or within the nearest window, a sign of notification that an occupancy permit must first be obtained from the Commissioner prior to occupying the dwelling or building.
