(a) Any person, firm or corporation seeking a building permit to construct any building, other than single and two-family dwellings within the City, when a mechanical waste water treatment plant is to be constructed to service the waste from such building, shall:
(1) Obtain written approval of the plans, specifications and discharge point from the Ohio Department of Health.
(2) Place on file with the Division of Engineering, a copy of the plans, specifications and written approval by the Ohio Department of Health.
(3) Submit an executed copy of a contract between the owner of the real property upon which the building and waste water treatment plant is to be constructed and a waste water treatment plant operator licensed by the State, providing for the perpetual maintenance and repair of the plant until its use can be discontinued and connection is made to the sanitary sewer system of the City. The contract shall be binding upon heirs, administrators, executors and assigns of the owner.
(4) Enter into a contract with the City providing for bimonthly inspection of the waste water treatment plant by the City Engineer or the Inspector designated for such purposes. The contract shall be in such form as determined by the City Solicitor and approved by Council. The permittee shall pay the inspection fees provided therein in accordance with the fee schedule as set forth in the contract.
(b) As to existing buildings, buildings under construction or buildings contemplated for which a building permit has been issued, any person, firm or corporation owning or operating an existing building or structure, a building or structure under construction, and any person, firm or corporation contemplating building a building or structure for which a building permit has been issued as of the passage date of this chapter (Ordinance 287-71, passed October 18, 1971), other than a single or two-family dwelling house within the City wherein or whereon or in connection with which a mechanical waste water treatment plant is used to service such building or structure shall also comply with the requirements of subparagraphs (1) through (4) hereof.
