779.03   CONDITIONS PRECEDENT TO ISSUANCE OF PUBLIC VEHICLE LICENSE.
   No license for the operation of public vehicles shall be issued unless and until Council, by resolution, declares that public convenience and necessity require the issuance of such license. The resolution shall specify the number of public vehicles in respect to which such license may be issued. Upon the passage of the resolution, approved by the Mayor, the Director of Public Safety shall be authorized to issue the license.
   Before the adoption of the resolution, Council shall provide for a public hearing or hearings, notice of the date of which shall be given to all existing licensees, as may be necessary to determine whether public convenience and necessity require the issuance of such license and the number of public vehicles in respect to which the license should be issued. In determining whether public convenience and necessity require the issuance of any such license, Council shall take into consideration:
   (a)   The number of public vehicles then licensed.
   (b)   Whether the requirements of public convenience and necessity can be met and complied with only by the issuance of such license or of any additional license.
   (c)   The resulting effect upon the business of existing licensees and upon the existing agencies of mass transportation.
   (d)   The effect on traffic congestion and safety of the public using the streets.
   (e)   The effect upon working conditions and wages or other compensation paid to drivers of public vehicles of existing licensees.
   (f)   The financial responsibility of the applicant.
   (g)   Any other factors which Council may deem relevant.
   In the event Council determines that public convenience and necessity require the issuance of any additional license, holders of existing licenses shall be given the opportunity to furnish any additional service in respect to which the claim is asserted that the licensing of additional public vehicles is required, and Council shall not authorize the issuance of any additional license unless existing licensees shall, within a time stipulated in the resolution, fail to provide the required additional service.
