777.08   TATTOOING DISEASED, INTOXICATED, OR DRUGGED PERSONS; MINORS.
   (a)   No person shall tattoo any person who is known to have or who shows signs of having any communicable disease or any disease of the skin, including rashes, pimples, boils, infections, or any other manifestation or evidence of unhealthy conditions. In addition, prior to tattooing, the operator shall inquire of the person getting a tattoo of the following conditions:
       (1)   History of jaundice or hepatitis;
      (2)   History of lymphadenopathy or lymphadenitis (swelling of the lymph nodes);
      (3)   History of AIDS; positive HIV test;
      (4)   History of blood donations exclusion (for other than hypertension and immediate illness);
      (5)   History of skin disease or skin cancer; or
      (6)   History of allergies that have caused an anaphylactic reaction.
   Persons indicating a history of any of the above shall not be tattooed.
    (b)   No person shall tattoo any person under the influence of alcohol and/or any drug.
   (c)   No tattoo operator shall be under the influence of alcohol and/or any drug.
    (d)   No person shall tattoo any person who is under twenty-one years of age, regardless of whether the operator knows this person to be less than twenty-one years of age or the operator is reckless in that regard.
