771.04   PERMITS.
    (a)   (1)   No person, firm or corporation or its distributor may manufacture, sell, market or otherwise dispose of any goods or articles to the public which, by way of any imprint, stamp, label, firm name or other printed matter, indicate that such goods or articles were made by blind workers or which by word of mouth or otherwise have been represented to be made by blind workers, without first obtaining a permit in writing from the Director of Public Safety upon a form prescribed by the Director.
      (2)   None of the provisions of this section are meant to apply to any person, firm or corporation marketing goods or articles made by blind workers on the premises of an established retail grocery or department or variety store permanently located within the City.
   (b)   Issuance of permits provided for in subsection (a) hereof shall be upon application submitted to the Director of Public Safety accompanied by an affidavit (as outlined in subsection (c) hereof) and such fees as the Director may establish, but not to exceed five dollars ($5.00) for each person, firm or corporation plus no more than one dollar ($1.00) for each agent or representative listed pursuant to subsection (c)(3).
   (c)   Every person, firm or corporation or its City distributor wishing to secure a permit shall submit the affidavit of such person, or, if a firm or corporation, the affidavit of its president, setting forth the following:
       (1)   Name, local address and phone number of the applicant.
      (2)   Name, local address and phone number of its president or local representative.
      (3)   Method of selling to be employed, that is, telephone, house-to-house solicitation, etc. The names of individual agents or representatives including solicitors of all types, whether telephone or house-to-house, and delivery men which such applicant believes will represent him.
      (4)   Whether products to be sold are products manufactured by blind persons.
      (5)   Assertion that such products meet all the standards set forth herein.
   No person shall knowingly submit an application or affidavit that is false in any of its particulars.
   (d)   The Director shall, upon receipt of the application and affidavit, issue the permits provided for in subsection (a) hereof when he is satisfied that the goods or articles to be manufactured, sold or marketed will meet the standards set forth herein. It shall be the responsibility of the applicant to properly complete the individual permit forms secured from the Director to reflect the required information for individual agents or representatives and further to keep the Director informed at all times of the current holder, if any, of such permit.
   (e)   The Director shall issue the regulations which may be necessary for the implementation of the various provisions of this chapter.
