(a) Whoever violates Section 737.09(a) is guilty of a misdemeanor of the third degree for a first offense and shall be fined not more than five hundred dollars ($500.00) or imprisoned not more than sixty days, or both. For a second or subsequent offense, such person is guilty of a misdemeanor of the second degree and shall be fined not more than seven hundred fifty dollars ($750.00) or imprisoned not more than ninety days, or both, for each offense. A separate offense shall be deemed committed each day during or on which a violation occurs or continues.
(b) Except as provided in paragraphs (b)(1) and (2) hereof, whoever violates Section 737.09(d) is guilty of a misdemeanor of the fourth degree and shall be fined not more than two hundred fifty dollars ($250.00) or imprisoned not more than thirty days, or both, for each offense. A separate offense shall be deemed committed each day during or on which a violation occurs or continues.
(1) If a violation of Section 737.09(d) results in injury to the property of another, then the offender is guilty of a misdemeanor of the second degree and shall be fined not more than seven hundred fifty dollars ($750.00) or imprisoned not more than ninety days, or both, for each offense. A separate offense shall be deemed committed each day during or on which a violation occurs or continues.
(2) If a violation of Section 737.09(d) results in injury to a person, then the offender is guilty of a misdemeanor of the first degree and shall be fined not more than one thousand dollars ($1,000) or imprisoned not more than six months, or both, for each offense. A separate offense shall be deemed committed each day during or on which a violation occurs or continues.
(c) Whoever violates any of the provisions of this chapter for which a penalty is not specifically designated is guilty of a misdemeanor of the third degree and shall be fined not more than five hundred dollars ($500.00) or imprisoned not more than sixty days, or both, for each offense. A separate offense shall be deemed committed each day or on which a violation occurs or continues.
