(a) No supplier of gas shall charge a rate which is more than twenty percent (20%) higher per gallon than the average cost per gallon in Cuyahoga County, as determined by the County Auditor, during emergency circumstances.
(b) “Emergency circumstances” means attack, disaster, or emergency as defined in Ohio R.C. 5502.21.
(c) Whoever violates this section is guilty of a misdemeanor of the first degree and shall be subject to the penalty provided in Section 698.02.
