351.175   IMPOUNDING OF VEHICLES PARKED WITHOUT PERMISSION.
   (a)   Police officers are authorized to provide for the removal without delay and impounding of any vehicle left upon private property without permission of the person having the right to possession of the property upon the filing of a written complaint stating the amount of time the vehicle has been left, stating that permission had not been given to leave the vehicle and requesting that the police remove the vehicle.
      (1)   Where the vehicle has been left for seventy-two hours or less, the complainant must also agree to pay all removal charges and the cost of storing the vehicle for the balance of the original seventy-two hour period. All storage costs incurred more than seventy-two hours after the vehicle was first left on the property without permission shall be assessed against the owner of the vehicle.
      (2)   Where the vehicle has been left more than seventy-two hours or in the special case where it has been left at a repair garage or place of storage for any period longer than agreed, all costs of removal and impoundment shall be assessed against the owner of the vehicle.
   (b)   Police officers are authorized to provide for the removal and impounding of any vehicle left on any public street or other property open to the public for purposes of vehicular travel, or upon or within the right-of-way of any road or highway, for forty-eight consecutive hours or longer without notification to the Police Division of the reasons for leaving the vehicle in such place. All costs of removal and storage shall be assessed against the owner of the vehicle.
   (c)   Notwithstanding the foregoing provisions, the Police Division, upon notification of the existence of an abandoned junk motor vehicle, shall take photographs of the vehicle, record the make and serial number and detail the damage or missing equipment substantiating the value of two hundred dollars ($200.00) or less. Thereafter, it shall be transported to a junk yard or scrap metal processing facility with which the City has a contract.
   (d)   Vehicles or abandoned junk motor vehicles impounded in accordance with subsection (a), (b) or (c) hereof shall be disposed of by the Police Division according to the procedures established in Ohio R.C. 4513.61, 4513.62 or 4513.63, as appropriate.
