173.25   REPLACEMENT OF RETIRING SUPERVISORY EMPLOYEES.
   (a)   If an employee who is serving in a civil service classified or unclassified supervisory or foreman position gives notice of his or her intention to retire or resign from the City’s employment, but the effective date of termination is delayed due to the use of vacation time, accrued overtime, sick leave or otherwise, then the pertinent appointing authority may proceed with the appointment of a replacement to the same position, from a civil service eligible list or otherwise in accordance with the Ohio civil service laws. If an appointment is made pursuant to this section, the term of the new appointment shall commence, and any probationary period shall run, from and after the date of appointment, even though the individual retiring or resigning has not yet been separated from the City’s employ.
   (b)   An appointment made pursuant to this section shall be immediately reported to the Civil Service Commission and Council, stating the reason for such appointment.
   (c)   Wages for an employee appointed pursuant to this section shall be paid from the payroll account of the retiring employee, at the rate otherwise provided for a newly appointed employee.
