173.21   HOLIDAYS.
   (a)   The following days are hereby declared to be legal holidays:
      (1)   January 1, known as New Year's Day;
      (2)   The third Monday in January, known as Martin Luther King, Jr. Day;
      (3)   The third Monday in February, known as Washington-Lincoln Day;
      (4)   The Friday immediately preceding Easter, known as Good Friday;
      (5)   The last Monday in May, known as Decoration or Memorial Day;
      (6)   The fourth day of July, known as Independence Day;
      (7)   The first Monday of September, known as Labor Day;
      (8)   The second Monday in October, known as Columbus Day, for those employees referred to in subsections (e) and (f) hereof;
      (9)   The eleventh day of November, known as Veterans' Day;
      (10)   The first Tuesday after the first Monday in November, known as General Election Day;
      (11)   The fourth Thursday in November, known as Thanksgiving Day;
      (12)   The Friday after Thanksgiving Day;
      (13)   The twenty-fifth day of December, known as Christmas Day.

   (b)   The City Hall shall be closed for general purposes on the days set forth in subsection (a) hereof in observance of such legal holidays, and such holidays, except as otherwise provided, are hereby declared to be paid holidays for all full-time City employees other than employees within the Parma Municipal Court, the office of the Clerk of Courts, and the Prosecutor's Office. However, an hourly paid employee in the Departments of Public Service and Public Safety shall not have the General Election Day as a paid holiday; in lieu thereof such employee shall have as his or her paid holiday the anniversary of his or her birthdate as shown in the personnel records of the Departments of Public Service and Public Safety, with the exception of all Charwomen who shall have the General Election Day as a paid holiday. The following salaried personnel within the Department of Public Service shall have as their paid holiday the anniversary of their birthdates in lieu of the General Election Day: Service Department Supervisors; Service Foremen; and Service Department Dispatchers. The following salaried personnel within the Departments of Public Service and Public Safety shall have as their paid holiday a second personal day in lieu of Martin Luther King, Jr. Day: Service Department Supervisors; Service Foremen; Service Department Dispatchers; and Sign Graphic Arts Supervisor.
   Within rank employees of the Division of Police may carry over any portion of the eleven legal City holidays, or the eighty-eight hour equivalent, from one year up to and including June 30 of the following year.
   Full-time employees within the Parma Municipal Court, the office of the Clerk of Courts, and the Prosecutor's Office within the office of the Solicitor shall observe as paid legal holidays the days designated in Ohio R.C. 325.19 and 1.14 for state employees and the political subdivisions of the State. Employees within the designated offices shall not be entitled to paid legal holidays applicable to all other full-time City employees.
   Full-time employee, as used herein, means a person who is listed on the rolls of the City as a regular or permanent employee and who works not less than seven hours a day, five days a week, on an annual work schedule.

   (c)   If any day designated in this section as a legal holiday falls on Sunday, the next succeeding Monday shall be a legal holiday. If any day designated in this section as a legal holiday falls on Saturday, the last preceding Friday shall be a legal holiday.

   (d)   A City employee shall forfeit his right to a paid holiday if he is absent from work on the workday last preceding a legal holiday or the workday next following a legal holiday if such absence is for a purpose other than vacation leave, hospitalization, death in the immediate family, jury duty, recovery from injury and duty injury which has been approved as such by the appropriate department head.

   (e)   Effective January 1, 1980, in addition to the paid holidays listed in this section, Columbus Day, being the second Monday in October, shall be included as a paid holiday for any employee within the positions designated in Schedule "A" attached to original Ordinance 33-80, passed February 18, 1980, and truck drivers, special equipment operators, fire hydrant supervisors, sign painters, maintenance specialists and timekeepers in the Department of Public Service.

   (f)   In addition to the paid holidays listed in this section, Columbus Day, being the second Monday in October, shall be included as a paid holiday for body repairmen-painters and apprentice body-repairmen.

   (g)   On and after the effective date of this subsection (Ordinance 94-82, passed June 9, 1982), an automotive mechanic, apprentice automotive mechanic, laborer (Class "A") or fire hydrant mechanic shall be entitled to an additional paid Personal Day, which shall be taken as a full day only.
