(a) If, for the good of public service to the City, it is deemed advisable to transfer any employee from one department or division to another, whether paid hourly or annually, such transfer shall in no way affect or cause a loss of seniority rights.
(b) When an employee is transferred from one department or division to another, he or she shall be assigned to the job position and salary category which, based upon duties, responsibilities, etc., is most comparable to the employee's most previous position. With respect to compensation levels in particular, whenever an employee is so transferred, he or she shall, to the extent allowed under applicable State civil service law, be assigned to the first compensation level (i.e., First Year, Second Year or Third Year pay step) which is equal to or exceeds the compensation level the employee had attained in his or her most previous position, provided that if none of the three pay steps is equal to or exceeds the employee's previous compensation level, then the employee will be assigned to the Third Year pay step for the new position.
(c) In the event an employee in the classified service is not permitted to transfer from one department or division to another, by virtue of State civil service law, and if such an employee resigns and is then appointed to another department or division of the City, he or she shall be considered as having transferred to such other department or division and shall retain all accumulated seniority rights.
