173.08   OVERTIME PAY; COMPENSATORY TIME OFF.
   (a)   No full-time, non-union employee of the City who is considered executive, administrative, professional, exempt for purposes of the Federal Fair Labor Standards Act, shall receive overtime or compensatory time in addition to their annual salary.
   (b)   All full-time, non-union employees who are not exempt for purposes of the Federal Fair Labor Standards Act may accumulate up to 200 hours overtime and such overtime to be taken by compensatory time off as approved by the appointing authority. Upon termination of employment, these employees shall be paid for all accumulated overtime hours not used, but not to exceed 200 hours overtime.
   (c)   All compensatory time compensatory for all City employees who are authorized to accumulate overtime shall be credited and redeemed at the prevailing hourly rate of pay in effect at the time the overtime hours are redeemed. The oldest hours shall be used on a first in-first out basis when granted off time is given under the direction of the Chief, in the case of police or fire personnel, or under the direction of the director in the case of other division or department personnel.
