(a) A resolution, rule or formal action of any kind is invalid unless adopted at an open meeting of a public body. A resolution, rule or formal action adopted at an open meeting that results from deliberations in a meeting not open to the public is invalid unless the deliberations were for a purpose specifically authorized by Section 107.05 and conducted at an executive session held in compliance with such section.
(b) Any person may file an action in Common Pleas Court in the event of a violation or threatened violation of any of the provisions of this chapter. Such Court has the power to issue an injunction to compel members of a public body to comply with such provisions.
(c) A member who knowingly violates such injunction may be removed from office by an action brought in the Court of Common Pleas for that purpose by the Prosecuting Attorney or the Attorney General. (Ord. 1-76. Passed 2-16-76.)
