(A) No person, firm or corporation shall construct or cause to be constructed a new driveway or relocate or reconstruct an existing driveway, including appurtenant drainage improvements, leading onto a private roadway or an existing or proposed public highway without first obtaining a permit from the Driveway Enforcement Officer. In the case of a state highway, a state highway permit shall be secured prior to the issuance of town driveway permit.
(B) Prior to commencement of any site excavation for any improvement which will ultimately require a driveway permit, an owner of property or an authorized agent of the owner shall make application for, and obtain, a driveway permit.
(C) The person, firm or corporation in whose name the driveway permit is issued shall be responsible for complying with all of the provisions of this subchapter and any other special conditions set forth on the driveway permit. All work associated with the driveway permit, whether on public or private property, shall be completed within two years from the date the permit is issued and shall be at the permittee’s expense.
(D) The various fees associated with administering this driveway subchapter shall be as follows:

(E) The applicant, upon application, agrees to hold the town harmless against any action for personal injury or property damage arising from the construction and/or use of the driveway.
(F) Forbearance period. For 60 days after the adoption of this revised subchapter (October 5, 2000), permit holders with existing incomplete driveways may reapply to the Driveway Enforcement Officer for an interim permit. The intent of the interim permit will be to allow construction of driveways to the minimum standards of either this revised subchapter or the regulations in effect at the time the original permit was issued. An interim permit will be at no cost for permits that are less than two years old.
