(a) The following terms as used in this code shall have the meanings ascribed to them as shown:
(1) "Normal wastewater" means wastewater which when analyzed shows by weight and daily average of not more than 200 parts per million of suspended solids, not more than 200 parts per million of biochemical oxygen demand and not more than 20 parts per million of oil and grease determined as total soluble matter.
(2) "Suspended solids" means solids that either float on the surface of or are in suspension in water, wastewater or other liquids and which are removable by laboratory filtering.
(3) "B.O.D." (biochemical oxygen demand) means the quantity of oxygen utilized in the biochemical oxidation of organic matter, under standard laboratory procedure, in five days at 20° C expressed in parts per million by weight.
(b) Wastewater or industrial wastes above normal wastewater strength but acceptable for discharge into the sanitary sewerage system shall be subject to a surcharge. The surcharge shall be determined on the basis of any or all of the following constituents of water or waste:
(1) Total suspended solids.
(2) Five-day biochemical oxygen demand at 20° C. and as herein provided.
(3) Emulsified oil or grease determined as total soluble matter.
(c) When any or all of the total suspended solids, biochemical oxygen demand or emulsified oil or grease of a water or waste accepted for admission to the system exceeds the values of their constituents for normal wastewater, the excess concentration in any or all, as the case may be, shall be subject to a surcharge as follows:
(1) Pounds of excess suspended solids as listed in the current Fee Ordinance.
(2) Pounds of excess biochemical oxygen demand as listed in the current Fee Ordinance.
(3) Pounds of excess oil and grease as listed in the current Fee Ordinance.
(d) (1) Addition to the surcharge, the user will pay the user charges as defined and set forth previously in this code.
(2) The pounds of biochemical oxygen demand, pounds of suspended solids and pounds of oil and grease per day, above the concentrations previously described for normal strength wastewater that are discharged to the wastewater treatment system, shall be determined by the City or their authorized representative.
(3) In addition to the surcharge on biochemical oxygen demand, suspended solids and oil and grease, the City shall have the right to surcharge any user for the discharge of any other pollutant into the wastewater system or for any other reason it deems necessary and appropriate, such as excessively high rates of discharge, requirements of special equipment or monitoring and other special circumstances.
(e) Any commercial user, as defined in this code, that serves or prepares food for human consumption shall pay a surcharge as per the current Fee Ordinance for 100 cubic feet of metered water consumption.
(f) Commercial user surcharges have been determined based upon sampling of the sewer system and the resulting conclusion that commercial users serving or preparing food in fact exceed the normal wastewater standard for oil and grease as set forth in this code.
(g) (1) Any commercial user that estimates that such user discharges an amount of oil and grease that is less than 20 parts per million shall have the option, at said user's expense, of installing a sampling manhole at a location, and constructed according to specifications, approved by the City Engineer.
(2) Whenever such a sampling manhole has been installed and approved by the City Engineer, the City shall take samples from such manhole at least once every three months provided said user shall have made such a request and shall have paid a sampling fee as per the current Fee Ordinance, payable for each such sampling request to the Finance Director.
(3) If the City sampling indicates said user to be exceeding 20 parts per million of oil and grease discharge, then such user shall pay a surcharge at the rate as per the current fee ordinance until such time as subsequent sampling, at the request and expense of said user or at the option and expense of the City, indicates said user to be discharging normal wastewater as defined in this code.
(4) If said City sampling indicates said user to be discharging 20 parts per million or less of oil and grease, then no surcharge will be assessed until such time as subsequent sampling, at the option and expense of the City, indicates a necessity for a surcharge due to a discharge of oil and grease in excess of 20 parts per million.
