6-1-13: PENALTIES:

   A.    Infraction:

      1.    It shall be an "infraction" as defined by Idaho Code section 49-110(5) for any person to violate sections 6-1-4 and 6-1-6 of this chapter, and the penalty for violation of sections 6-1-4 and 6-1-6 of this chapter shall be by fine consistent with rule 9 of the Idaho infraction rules.

      2.    It shall be an "infraction" as defined by Idaho Code subsection 49-110(5) for any person to violate section 6-1-5 of this chapter, and the penalty for violation of section 6-1-5 of this chapter shall be by fine of one hundred dollars ($100.00) plus those costs consistent with the Idaho infraction rules.    B.    Misdemeanor:

      1.    It shall be a misdemeanor for any person to exceed the vehicle weight restriction set by ordinance, rule, or resolution pursuant to section 6-1-5 of this chapter by ten percent (10%) of the limit or more.

      2.    Any other violation of this chapter shall be a misdemeanor. (Ord. 05-03, 8-1-2005, eff. 10-1-2005)
