§ 93.001 NUISANCES DEFINED.
   (A)   All acts described, regulated and prohibited in the provisions hereof are hereby deemed to be, and are hereby declared to be, nuisances and all of such acts shall constitute penal offenses and, in addition to abatement as in this chapter, shall be punishable as penal offenses.

   (B)   Whoever, by his or her act or failure to perform a legal duty, intentionally does any of the following is guilty of maintaining a public nuisance, which is a misdemeanor:
      (1)   Maintains or permits a condition which unreasonably annoys, injures or endangers the safety, health, morals, comfort or repose of any considerable number of members of the public;
      (2)   Interferes with, obstructs or renders dangerous for passage, any public highway or right-of-way or waters used by the public;
      (3)   Is guilty of any other act or omission declared by law or this chapter to be a public nuisance and for which no sentence is specifically provided;
      (4)   Maintains or permits a condition in violation of this chapter; or
      (5)   Maintains or permits a condition in violation of §§ 151.01 through 151.11 of the City of Owatonna Minnesota Housing Code.
