(A) For the purpose of this schedule, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
NORTH CEDAR AVENUE ZONE. Both curb lines of North Cedar Avenue from the intersection of Broadway Street to the intersection of Fremont Street.
OCCUPYING. Sitting within the passenger compartment of a motor vehicle, sitting or standing on top of a motor vehicle or leaning against the outside of a motor vehicle and, in the case of a pickup truck, occupying the box of the truck.
STOPPING. Any halting, even momentarily, of a vehicle, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic-control sign or signal. STOPPING includes PARKING.
(B) No person shall occupy a stopped or parked vehicle in the North Cedar Avenue Zone between the hours of 9:00 p.m. and 2:00 a.m.
(C) Exceptions:
(1) Division (B) above shall not apply to any person boarding or alighting from a parked motor vehicle; and/or
(2) Any physically disabled person within a vehicle entitled to the privileges under Minn. Stat. § 169.345, as it may be amended from time to time.
(D) The penalty for a violation of division (B) above shall be as provided in § 72.99 of this code of ordinances.
