(a) No person shall operate a snowmobile or all purpose vehicle or be a passenger on a snowmobile or all purpose vehicle unless wearing a protective helmet on his head with a chin strap properly fastened, and using safety glasses or other protective eye device. Such helmet, safety glasses or other protective eye device shall conform with regulations prescribed and promulgated by the Director of Highway Safety. The provisions of this paragraph or any violation thereof shall not be used in the trial of any civil action.
(b) All operators of snowmobiles or all purpose vehicles shall be subject to all other traffic regulations as set forth in Ohio R.C. 4511.01 et seq. (Ord. 995. Passed 7-10-78.)
(c) Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
