351.16 STREET AND UTILITY REPAIRS AND OTHER EMERGENCIES.
   (a)   In the event a lawfully parked vehicle obstructs or restricts the repair of any street, sidewalk or utility within the Village, or in the event of any other emergency determined by the Mayor or his designee or by the Chief of Police, the Village may remove or move any such lawfully parked vehicle to another location at the expense of the Village. In such event, the Village shall make every attempt to notify the owner of the location to which the vehicle has been removed, and, where possible, request the owner to move the vehicle prior to its being removed by the Village.    (b)   Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
