157.08 OVERTIME/COMPENSATORY TIME/FLEX-TIME.
   (a)   Employees shall be paid at the rate of one and one-half times the hourly rate for all hours over forty hours actually worked in any one week. A week shall start at 12:00 a.m. on Sunday and end at 11:59 p.m. on Saturday. Police Officers will be compensated at the rate of one and one-half times the hourly rate for all hours exceeding eighty (80) hours actually worked in a pay period. For purposes of this section, sick leave, FMLA or any other time period that is not considered hours actually worked will not be include in the minimum hours necessary to qualify for overtime pay.

   (b)   Non-FLSA exempt employees may elect to take compensatory time off in lieu of receiving cash payment for overtime worked, at the rate of one and one-half hours off for each hour of overtime worked. Employees may accrue a maximum of forty (40) hours of compensatory time at any one time. All overtime hours worked in excess of the forty (40) hour limit shall be paid in cash.
   (c)    The Employer may utilize "time off" or flexible hours in order to avoid having employees work in excess of forty (40) hours in a work week or eighty (80) hours in a pay period. (Ord. 09-19. Passed 12-14-09.)
