959.02 FEES, CHARGES AND PROCEDURE FOR PURCHASE OF CRUSHED STONE AND/OR ASPHALT GRINDINGS.
   (a)   An application must be completed at the Village Clerk's Office and payment must be made prior to removal of any amount of crushed stone or asphalt grindings from the Municipal Garage. Upon review of the application, the Village retains the right to deny the privilege of selling crushed stone or asphalt grindings to any person at any time.
   (b)   The applicant must give the Village notice of at least 24 hours before purchasing unless the Village of Ottawa agrees to notice of less than 24 hours because of an unusual circumstance.
   (c)   The applicant may only purchase and pick up crushed stone or asphalt grindings weekdays during staffed hours unless special arrangements are made in which case the applicant will be responsible for paying the time costs for Village employees required to accommodate applicant's special arrangements.
   (d)   The Village of Ottawa employees will load the crushed stone or asphalt grindings with motorized equipment provided application has been properly filed and payment made.
   (e)   The Village does not assume any liability for the quality of the crushed stone or asphalt grindings after delivery to applicant.
   (f)   Whoever violates any of the provisions of this chapter shall be deemed guilty of a misdemeanor of the fourth degree and fined not more than two hundred fifty dollars ($250.00). Each day's continued violation shall constitute a separate offense.
