545.22 THEFT OF FIREWOOD.
   (a)   Upon the trimming or cutting down of trees within its rights-of-way, the Village of Ottawa may offer a first option to an adjacent landowner to retain the firewood. If, after a reasonable amount of time, the landowner has not removed the firewood from the area of trimming or cutting to a safe area, the Village may remove the firewood with no further warning.
   (b)   It shall be considered a theft pursuant to Ohio R.C. 2913.02 for any individual, other than the homeowner or the Village of Ottawa, to remove the firewood without authority.
   (c)   A violation of this section is a theft and shall be a misdemeanor in the First Degree. If the value of the firewood stolen exceeds Five Hundred Dollars ($500.00) or more but is less than Five Thousand Dollars ($5,000.00), a violation of this section shall be a felony of the Fifth Degree. Thefts greater than Five Thousand Dollars ($5,000.00) shall be classified and subject to the penalties set forth in Ohio R.C. 2913.02.
