945.08 PUBLIC TREE PLANTING.
   (a)   No species may be planted on public property without the written consent of the Shade Tree Commission.
   (b)   The spacing of public trees will be in accordance with the three species size classes referred to in Section 945.02(a) and every tree shall be planted accordingly in the following areas: (Based on the discretion of the Shade Tree Commission)
 
Small Trees
-Thirty Feet (30')
Medium Trees
-Forty Feet (40')
Large Trees
-Fifty Feet (50')
   (c)   The distance public trees may be planted from curbs or curb lines and sidewalks shall be in accordance with the three species size classes referred to in Section 945.02(a) and shall attempt to maintain the following distances when practical: (Based on the discretion of the Shade Tree Commission)
 
Small Trees
-Two Feet (2')
Medium Trees   
-Three Feet (3')
Large Trees
-Four Feet (4')
   (d)   No public trees shall be planted closer than thirty-five feet from any street corner, measured from the point nearest the intersecting curbs or curb lines. No public trees shall be planted closer than ten feet from any fire hydrant.
   (e)   No public tree, other than those specified as small trees in Section 945.02(a), may be planted under or within twenty-five feet laterally of any overhead utility wire.
   (f)   All existing public trees shall be grandfathered.
