(a) If any person discharge sewage, industrial wastes or other wastes into the Village’s Sanitary Sewage System contrary to the provisions of this chapter, or any lawful order of the Village, or who falsifies information pertaining to any waste discharge or reporting requirements, or who knowingly renders inaccurate any monitoring device or method required under this chapter, or who willfully or negligently violates any provision of this chapter, the Law Director may, after following the authorization of such action from the Utilities Board or Council, may commence an action for appropriate legal or equitable relief, or both, in the proper court of this County. Such a violation shall be a misdemeanor, punishable by a five hundred dollar ($500.00) fine per violation per day fine and actual damages incurred by the Village per violation per day as long as the violation continues. Each day or portion thereof during which a violation occurs shall be considered a separate offense.
(b) Whoever violates any provision of this chapter, or any lawful order or permit of the Village issued hereunder shall be liable for a civil penalty of five hundred dollars ($500.00) per violation per day fine for as long as the violation continues. Each day or portion thereof during which a violation occurs shall be considered a separate offense.
