925.14 BULK SEWAGE DISPOSAL; FEES AND CHARGES.
   (a)   No person shall dispose of bulk sewerage in the Village without first making an application therefor at the Clerk's Office. Bulk sewerage is sewerage that is transferred from any container or receptacle to the Village system at any point, other than where metered. Upon review of the application, the Utilities Director or Municipal Director retains the right to deny the privilege of disposing the bulk sewerage to any person at any time.
   (b)   The application fee shall be thirty dollars ($30.00) per calendar year with no apportionment for the date such application is made and such fee shall be nonrefundable.
   (c)    The general rate of one (1) gallon sewerage or portion thereof shall be:
      (1)    $ .10 for every gallon of leachate
      (2)    $ .12 for every gallon of septic
   Payable within 30 days of being invoiced by the Village. All other sewerage must be negotiated by the Utilities Director or Municipal Director. Rates may be increased by the Utilities Director or Municipal Director if in their sole opinion said person’s circumstances are deemed to warrant same. The Utilities Director and Municipal Director, collectively, shall have the right to enter into contracts with any user for a period not to exceed three years at the rate being charged by the Village at the time the contract is entered into and said rate may remain constant for the duration of the contract.

   (d)   The applicant/user must provide the Village with vehicle license numbers and the name of operators of the vehicles and must keep such information updated. Vehicles shall be equipped in such a way as to prevent backflow or cross connection.
   (e)   The applicant/user may only dispose of sewerage weekdays during normal business hours unless special arrangements are made in which case the applicant/user will be responsible for paying the time costs for the village employees required to accommodate applicant/user’s special arrangements. The applicant/user must give the Village notice of at least 24 hours before dumping unless the Utilities Director or Municipal Director agrees to notice of less than 24 hours because of an unusual circumstance.
   (f)   The sewerage dumping site shall be predetermined and the applicant/user shall discharge the sewerage only at such site. The Village may request the applicant/user to submit a chemical analysis of the material to be disposed of to the Village. A manifest must be supplied to the Village employees before any sewerage dumping occurs. Samples shall be taken of all materials disposed of and said samples shall be labeled and retained by the Village. The applicant/user will be liable to the Village for any extra costs, fines or penalties incurred by the Village as a result of any deviations from the manifest found when analysis is performed.
   (g)   Violations of this section could result in permanent suspension of disposing privileges. The Utilities Director or Municipal Director shall enforce the provisions of this section. An additional fee of up to five hundred dollars ($500.00) will be required if any sewerage is left on-site by the applicant/user disposing of the bulk sewerage. Proper clean-up will be determined by a Village employee.
   (h)   This section is subject to any changes in E.P.A. Regulations.
