713.09 CONDITIONS FOR STREET OCCUPANCY.
   (a)    Use. All transmission and distribution structures, lines and equipment erected by the Company within the Village shall be located so as to cause minimum interference with the proper use of streets, alleys and other public ways and places, and to cause minimum interference with the rights or reasonable convenience of property owners who adjoin any of such streets, alleys or other public ways and places.
   (b)   Restoration of Sidewalks. In case of any disturbances of pavement, sidewalk, driveway or other surfacing, the Company shall, at its own cost and expense and in a manner approved by Council, replace and restore all paving, sidewalk, driveway or surface of any street or alley disturbed, in as good a condition as existed before such work was commenced and shall maintain the restoration in an approved condition for a period of one year.
   (c)    Relocation. In event that at any time during the period of this franchise the Village shall lawfully elect to alter, or change the grade of, any street, alley or other public way, the Company upon reasonable notice by the Village shall remove, relay and relocate its poles, wires, cables and other television fixtures at its own expense.
   (d)    Placement of Fixtures. Poles, posts and other structures of telephone companies, power companies and others which may be made available to the Company by such companies for leasing or licensing, shall be used to the extent practicable in order to minimize interference with travel. Before the Company sets poles or constructs any structure on Village property it shall file with the Village notice of its intention, which notice shall specify the exact location, height and dimensions of the poles or structures to be erected. The poles or structures shall not be erected thereafter until such specifications shall be approved in writing by the Council. In all street installations, the wires, cables and other fixtures shall be not less than twenty feet from the surface of the grounds.
   (e)    Temporary Removal of Wire for Building Removal. The Company shall on the request of any person holding a building moving permit issued by the Village, temporarily raise or lower its wires to permit the moving of buildings. The expense of such temporary removal, raising or lowering of wires shall be paid by the person requesting the same and the Village shall have the authority to require such payment in advance. The Company shall be given not less than forty-eight hours' advance notice to arrange for such temporary wire changes.
   (f)    Tree Trimming. The Company shall have the authority to trim trees upon and overhanging streets, alleys, sidewalks and public places of the Village so as to prevent the branches of such trees from coming in contact with the wires and cables of the Company with all trimming to be done under the supervision and direction of the Village and at the expense of the Company.
   (g)    Removal of Wires, Poles and Installation From Premises of Subscribers. The Company shall, on the request of any subscriber, promptly remove all wires and installations from the premises of such subscriber.
   (h)    Removal of Wires, Poles and Installations from Village Streets. The Company shall remove or cause to be removed from the streets of the Village and from all public property all of the wires, poles and installations of any kind or nature whatsoever which have been installed under the authority of this franchise, upon the expiration of the terms of this franchise or any extension thereof; the cessation of operation under this franchise by the Company, its successors or assigns, for any reason whatsoever; or the forfeiture of this franchise.
   (i)    Map of Service Area. The Company shall file with the Village at the end of July of each year a map showing the area of the Village being served. (Ord. 851. Passed 9-28-70.)
