2-4-9: INTERMENT OR DISINTERMENT REQUIREMENTS:
   A.   Interments And Disinterments: No person or persons except bona fide employees of the city or a city approved contractor with suitable equipment and ability to perform may dig any grave or make any interment or disinterment in the Orting Cemetery. All contractor interments and disinterments shall be under the direction of the caretaker. Owners of graves or niches must arrange for such interment or disinterment with the city public works director. No interments or disinterments may be made unless all fees for interment rights and for services have been paid or satisfactorily arranged for with the public works director. No interments, disinterments or removals shall be permitted on Sunday or any holiday observed by the city except in case of contagious disease as required by law or by special approval from the public works director.
   B.   Requirements For Disinterment:
      1.   Approval Of Nearest Kin: Signed affidavit(s) of the nearest kin approving the disinterment or removal.
      2.   Approval Of Lot Holder: Signed approval of the lot holder or their lawful representative.
      3.   Disinterment Permit: Disinterment permit from city and any other necessary state and county approvals and/or permits.
      4.   Interment Right: The desired interment right must be identified; all charges for disinterment and reinterment, together with all other charges due, must be paid.
      5.   Remains From Other Cemeteries: Remains removed from other cemeteries and brought to the Orting Cemetery for reinterment must be accompanied by the proper paperwork and permits required by law.
      6.   Liability: The city will exercise utmost care in making a disinterment, but assumes no liability for damage to any casket, vault, liner, grave box or any other burial case in making the removal or disinterment.
      7.   Outer Case Replacement: When, in the opinion of the city, a new outside box is needed, it must be provided by the person arranging for the removal, at the time of reinterment, through the cemetery.
      8.   Prior Notice: At least one week's prior notice is required for any disinterment or removal, after compliance with the rules and regulations.
      9.   Removal For Profit Prohibited: Removal by the heirs of any remains so that the lot may be sold for profit is not permitted. (Ord. 2015-969, 7-29-2015)
