A. Interference With Code Enforcement Unlawful; Misdemeanor: Any person who intentionally obstructs, impedes or interferes with any lawful attempt to serve a notice of civil violation, notice of civil infraction or civil regulatory order, or intentionally obstructs, impedes or interferes with lawful attempts to correct a violation shall be guilty of a misdemeanor.
B. Fraud; Deception; Knowingly Falsify; Gross Misdemeanor: Any person who shall knowingly and falsely make, complete, or alter a written instrument required by a regulation or a provision of the development code shall be guilty of a gross misdemeanor. Proof of intent to defraud or injure is not required.
For purposes of this section, the following words and phrases shall have the meaning given herein:
COMPLETE WRITTEN INSTRUMENT: One which is fully drawn with respect to every essential feature thereof; "incomplete written instrument" means one which contains some matter by way of content or authentication but which requires additional matter in order to render it a complete written instrument.
FALSELY COMPLETE A WRITTEN INSTRUMENT: To transform an incomplete written instrument into a complete one by adding or inserting matter, without the authority of anyone entitled to grant it; and, to "falsely alter" a written instrument means to change, without authorization by anyone entitled to grant it, a written instrument, whether complete or incomplete, by means of erasure, obliteration, deletion, insertion of new matter, transposition of matter, or in any other manner.
FALSELY MAKE A WRITTEN INSTRUMENT: To make or draw a complete or incomplete written instrument which purports to be authentic, but which is not authentic either because the ostensible maker is fictitious or because, if real, the maker did not authorize the making or drawing thereof.
WRITTEN INSTRUMENT: Any paper, document, or other instrument containing written or printed matter or its equivalent, or any stamp, seal, certification, trademark, or other evidence or symbol of value, right, privilege, or identification.
C. Transfer Of Ownership; Misdemeanor: It shall be unlawful for the owner of any building, structure, premises or land who has received a civil regulatory order or upon whom a notice of violation or correction notice has been served pursuant to this chapter to sell, transfer, mortgage, lease or otherwise dispose of such building, structure, premises or land to another until the provisions of the civil regulatory order, correction notice or notice of violation have been complied with, or until such owner shall first furnish the grantee, transferee, mortgagee or lessee a true copy of any civil regulatory order, correction notice or notice of violation issued by the code enforcement officer and shall furnish to the code enforcement officer a signed and notarized statement from the grantee, transferee, mortgagee or lessee, acknowledging the receipt of such civil regulatory order, correction notice or notice of violation and fully accepting the responsibility without condition for making the corrections or repairs required by such civil regulatory order, correction notice or notice of violation. A violation of the provisions of this subsection shall constitute a misdemeanor. (Ord. 912, 9-14-2011)
