8-2-2: NEW RESIDENCES, CONVERSIONS TO COMMERCIAL USE IN MIXED USE-TOWN CENTER ZONE AND IMPROVED PROPERTY:
   A.   All new residences, all existing residences within a mixed use-town center zone being converted to commercial use, and all property improved by new construction thereon shall have sidewalks constructed on all sides abutting on a public street of the property being developed before buildings on the subject properties shall be occupied or used.
   B.   Where unfavorable weather conditions or good construction practice require a delay in completion of the sidewalk construction, the city may grant a waiver on the occupancy or use of the building upon receiving assurances acceptable to the city that the sidewalk construction will be completed in a timely manner.
   C.   "New construction", for the purpose of this chapter, shall be defined as the construction of a new building or reconstruction of an existing building where more than fifty percent (50%) of the value of said building immediately after completion of all reconstruction is represented by newly constructed improvements.
