5-7-2: PERMIT; APPLICATION AND FEE:
   A.   Permit Required; Fee: Any person or entity desiring to sell fireworks or to perform any activities as set forth in Revised Code Of Washington 70.77.255 shall apply in writing to the fire chief of fire district 18, or its successor, for a permit and pay a fee as set by resolution of the mayor and city council.
   B.   Exemption From Fee: Said fee shall not be required of nonprofit charitable corporations.
   C.   Issuance Or Denial Of Permit: The fire chief of fire district 18, or its successor, shall make a written recommendation to the mayor or designee and the mayor or designee shall, in consideration of the criteria set forth in Revised Code Of Washington chapter 70.77 et seq., have the authority in his/her discretion to grant or deny the permit, subject to reasonable conditions, if any, as he/she shall prescribe.
   D.   State License Required: The applicant must first have obtained a license from the state fire marshal as provided in Revised Code Of Washington 70.77 et seq. (Ord. 909, 6-29-2011)
