5-2-8: WASTE RECYCLING; SEPARATION OF GARBAGE:
   A.   Mandatory Recycling: In order to support waste recycling programs, the city reserves the right to and may require the separation of recyclable material and the deposit thereof in separate cans or receptacles, and may further prescribe the methods of disposal thereof.
   B.   Ownership Of Recyclable Material: Once recyclable material or yard debris has been set out for collection on the curbside, or at such other location agreed to by a contract carrier pursuant to a service agreement with the city, ownership of such recyclable material and yard debris passes to the contract carrier under the terms of the current service agreement with the city. It shall be unlawful for any person other than the contract carrier to remove or collect any such recyclables, garbage, and/or yard debris once they are set out for collection. However, any person may collect recyclable and/or yard debris materials delivered to such person at a location where it is legal to accept such materials. In addition, any person may collect commercial source separated materials from his or her own containers, or uncontainerized commercial source separated materials from his or her customers.
