5-2-6: BIOMEDICAL AND HAZARDOUS WASTE:
   A.   It is unlawful for any person to bury, burn, dump, collect, remove, or in any manner dispose of biomedical waste upon any street, alley, public place, or private property within the city, other than as provided in this chapter. It is unlawful for any person to place any biomedical waste in a container for collection as solid waste by the city. Such wastes shall be delivered by the person generating such waste to an appropriate and authorized handler of such wastes for proper disposal in accordance with applicable state law. Any person found to have violated this provision shall be subject to both civil penalties and/or criminal prosecution under any and all federal, state, or local laws that may apply or may be hereafter adopted. In addition to any such penalties, a violation of this section shall constitute a class 1 civil infraction and shall be punishable by a maximum fine of up to two hundred fifty dollars ($250.00) for each violation.
