It shall be the duty of the Planning and Zoning Commission to:
A. It shall be the duty of the planning and zoning commission to conduct a comprehensive planning process designed to prepare, implement, and review and update a comprehensive plan, hereafter referred to as the plan. The land shall include all land within the jurisdiction of the governing board;
B. The Comprehensive Plan is to be updated on an as needed basis;
C. Hold public hearings prior to recommendations pertaining to the Comprehensive Plan, changes to the plan, and ordinances relative thereto;
D. Provide ways and means to obtain citizen participation in the planning process;
E. Recommend to the Council subdivision and zoning ordinances;
F. Recommend to the Council any changes to the Comprehensive Plan and zoning ordinances prior to the annexation of an unincorporated area;
G. Recommend to the Council a map, a governing plan and ordinances for the City and the Impact Area;
H. Provide ways and means to obtain citizen participation in the administration of the duties of the Commission including, but not limited to, appointing nonvoting ex officio advisors, establishing subcommittees and advisory committees, and organizing neighborhood groups;
I. Prepare procedures for processing zoning permits, special use permits, rezoning applications, planned unit development proposals and variance applications;
J. Hear all requests for amendments to the zoning ordinances, hold at least one public hearing thereon, and make recommendations to the Council;
K. Recommend to the Council changes to the zoning ordinances which the Commission deems appropriate;
L. Recommend to the Council the adoption of coordinated plans for the physical development of the City;
M. Recommend to the Council the formation of zoning districts;
N. Make recommendations to the Council concerning the layout, design, widening, extending and locating the streets, roads and highways for relief of traffic;
O. Make recommendations to the Council concerning the density of population and development of land within the city;
P. Make recommendations to the Council concerning the future growth, development and beautification of the city in respect to its public buildings, streets, parks, grounds and land consistent with the future growth and development of the city and the impact area in order to promote the public health, morals, safety and welfare of the inhabitants thereof;
Q. Make recommendations to the Council for legislation and regulations concerning the landscaping and the location of buildings, structures, or works to be erected, constructed, or altered and to give suggestions and advice to individuals concerning such landscaping and the location of buildings, structures, or works to be erected, constructed, or altered;
R. Hear all applications for special exceptions, special uses, zoning changes and/or variances and make recommendations to the Council thereon; provided, that the Commission shall not submit such recommendations to the Council until a public hearing is held at which interested persons shall have an opportunity to be heard following notice as provided in Sections 11-2-14, 11-2-15, 11-2-16, and 11-2-17 of this Code as is applicable;
S. With the consent of the owner, through its members, officers, agents and employees, in the performance of their functions, enter upon any land and make examinations and surveys and place and maintain necessary monuments and marks thereon;
T. Consider and pass upon all maps, plats and re-plats of lands which require the approval of the Council. Any and all maps, plats and re-plats shall be first submitted to the Commission for its consideration and recommendation to the Council; and
U. Perform any other duties deemed appropriate by the Council which do not conflict with the laws of Idaho. (Ord. 544, 4-22-1980; amd. Ord. 791, 5-23-2017)
