1-1-1: OGDEN MUNICIPAL CODE ADOPTED:
Pursuant to the provisions of Utah Code Annotated sections 10-3-707 through 10-3-711, as amended, and successor sections, there is hereby adopted the Ogden Municipal Code, as compiled, edited and published by the authority of the Council of Ogden City.

1-1-2: TITLE; CITATION; REFERENCE:
This Code shall be known as the OGDEN MUNICIPAL CODE. It shall be sufficient to refer to the Code as the Ogden Municipal Code in any prosecution for the violation of any provision thereof, or in any proceeding at law or equity. It shall be sufficient to designate any ordinance adding to, amending, correcting or repealing all or any part or portion thereof as an addition to, amendment to, correction or repeal of the Ogden Municipal Code. Further reference may be had to the titles, chapters, sections and subsections of the Ogden Municipal Code, and such references shall apply to that numbered title, chapter, section and subsection as it appears in the Code. Whenever a reference is made to this Code as the Ogden Municipal Code, or to any portion thereof, or to any ordinance of the City, the reference shall apply to all amendments, corrections and additions heretofore, now or hereafter made.

1-1-3: CODIFICATION; EFFECT ON PRIOR LEGISLATION:
   A.   This Code consists of all the regulatory and penal ordinances and certain of the administrative ordinances of the City, codified pursuant to the provisions of Utah Code Annotated sections 10-3-707 through 10-3-711, as amended, and successor sections.
   B.   The adoption and recodification of these ordinances shall supersede all ordinances previously codified as part of the 1979 Code and all ordinances comprising the Zoning Ordinance, which was not included in the 1979 Code.
   C.   This Code shall not supersede or repeal uncodified ordinances or ordinances of a private, local or temporary nature, including, but not limited to: ordinances authorizing the execution and issuance of bonds; ordinances related to the creation of special improvement districts; budget ordinances; ordinances relating to boundaries and annexations; the adoption of the Zoning Map or any amendments thereto; ordinances relating to the vacating or naming of streets; franchise ordinances or other ordinances granting special rights to persons or corporations; ordinances relating to elections, etc.

1-1-4: REFERENCES TO SPECIFIC ORDINANCES:
The provisions of this Code shall not in any manner affect matters which have heretofore been made of record and which refer to ordinances specifically designated by number. Any such reference shall be construed to apply to the corresponding provisions contained within this Code.

1-1-5: EFFECT OF CODE; PAST ACTIONS AND OBLIGATIONS:
Neither the adoption of this Code nor the repeal or amendments hereby of any ordinance or part or portion of any ordinance of the City shall in any manner affect or impair any right which has accrued, any duty which was imposed, any act performed, any penalty incurred or which may be applied, or any suit, prosecution or proceeding, under previous ordinances. The provisions of all general ordinances contained in this Code shall be deemed to be continuing provisions and not a new enactment of the same provisions; nor shall this Chapter be deemed as discontinuing, or as effecting the liability of any person, firm or corporation, or as waiving any right of the City under any ordinance or provision thereof in force at the time of the adoption of this Code.

1-1-6: ORDINANCES PASSED BEFORE CODE ADOPTION:
The last ordinance included in the initial code is Ordinance 99-16, passed March 16, 1999. Ordinances passed subsequent to Ordinance 99-16, but prior to the adoption of this Code, are hereby adopted and made a part of this Code.

1-1-7: TECHNICAL CORRECTIONS:
Sterling Codifiers, Inc., of Coeur d'Alene, Idaho, as the compiler of this Code, or such other editor or publisher as hereafter appointed by the Mayor, is authorized to assign numbers and headings to titles, chapters and sections, and to make technical corrections to this Code.
