7-2-18: WEIGHT AND OTHER RESTRICTIONS:
   A.   The city engineer may prohibit the operation of any vehicle or impose restrictions on the weight of a vehicle operating upon any street or roadway under the jurisdiction of Ogden City if:
      1.   Following an engineering inspection or study, the city engineer determines that the roadway:
         a.   Will be damaged or destroyed due to deterioration caused by climatic conditions;
         b.   Is subject to damage or destruction due to the condition of the roadway, including:
            (1)   The structural cross section of the roadway;
            (2)   The age of the roadway; and
            (3)   The effect of different types of vehicles on the integrity of the roadway;
         c.   Is subject to congestion as a result of narrow travel lanes or inadequate turning radii; or
         d.   Is unable to meet an established level of service standard due to the presence of vehicles of a certain weight; and
      2.   Signs are erected and maintained citing the weight limit at each end of that portion of any street affected by the determination.
   B.   A restriction imposed pursuant to subsection A of this section shall not be construed to prohibit:
      1.   The operation of emergency vehicles upon any street in the city;
      2.   The operation of restricted vehicles owned or operated by the city, public utilities, or any contractors or materialmen, while engaged in the repair, maintenance, snowplowing, or construction of such streets, street improvements, or public utilities within the city;
      3.   The operation of school buses and other forms of public transit upon any street in the city;
      4.   The operation of a restricted vehicle where a permit has been issued by the mayor or city engineer; or
      5.   The operation of restricted vehicles upon any officially established detour in any case where such vehicle could lawfully be operated upon the street for which such detour is established.
   C.   Any person who violates any restriction imposed under the authority of this section is guilty of an infraction class C misdemeanor, subject to penalty as provided in title 1, chapter 4 of this code.
