(a) No building or structure shall be constructed, altered, remodeled, re-certified, razed or removed except in conformity with the provisions of this Part Thirteen – Building Code except all single family structures shall not be required to comply with the provisions of Part Thirteen Building Code when being altered or remodeled where no structural changes are to be made.
(b) No building, structure or part thereof that has been erected or altered in violation of the provisions of this Building Code after its effective date may be occupied or used and must be removed or brought into compliance with adopted codes.

The following building codes are hereby adopted by reference and made the Building Code of the Village of Obetz as fully as if they were set forth herein in full:
(a) In order to regulate the erection, construction, repair, alteration and maintenance of residential dwellings, the Residential Code of Ohio for One-, Two-, and Three- Family Dwellings as adopted by the Ohio Board of Building Standards pursuant to Ohio R.C. 3781.10, shall apply and be enforced within the Municipality.
(b) For all other construction, the current edition of the Ohio Building Code including the latest supplements, as issued by the Department of Commerce of the State of Ohio, shall represent minimum standards for all building and structures other than one-, two-, and three-family units constructed and erected in the Village.

(a) No existing building shall be altered or repaired when the value of such alterations or repairs is equal to or greater than one-half of the value of the building, exclusive of the value of the foundation, unless upon completion of such alterations or repairs, the entire building will meet all requirements of this Building Code.
(b) Any existing building which may be damaged to an extent of fifty percent or more of its value, exclusive of the value of the foundation, may be repaired or rebuilt only when upon completion of such repairs or rebuilding the entire building will meet all the requirements for building hereafter erected. Any existing building which is damaged to an extent of fifty percent or more of its value, exclusive of the value of the foundation, and cannot be repaired in such a manner as to meet requirement of this Building Code, must be raised and the foundations removed, leaving the site cleaned of all debris.
(c) Under the provisions of this section the amount and extent of the damage shall be determined by the Building Inspector. However, any property owner dissatisfied with the determination may file a written notice of appeal to the Village Council of the Inspector’s decision and Council shall promptly act upon such appeal and affirm or reverse the decision of the Inspector. All application, permit, inspection, re-inspection, document examination, certificate of occupancy, and other fees as established in the Chapters constituting Part Thirteen of the Codified Ordinances shall be accompanied by the fees adopted by Council in the Fee Schedule.

(a) All new structures with the exception of accessory structures shall have a continuous foundation or shall be constructed on a monolithic slab unless otherwise approved by the Chief Building Official.
(b) Roofs constructed over decks shall be independent of the deck unless the Chief Building Official can determine that the deck can handle the additional load.
(c) An existing deck may be converted to a screened in porch with permanent screens and no windows provided the Chief Building Official determines that the deck can handle the additional load.
(d) A three season room that is unheated and separated from the principal structure by a solid door may only be constructed on a deck if the Chief Building Official determines that the deck can handle the additional load. (Ord. 03-16. Passed 2-22-16.)
All permits issued under this chapter shall expire if work thereunder does not progress under a schedule at least as rapid as the following:
