§ 151.999 PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99.
   (B)   Any person violating any provision of § 151.020 shall be fined not less than $250 for the first offense, $500 for the second offense, and $1,000 for the third and each subsequent offense on the same property by the same person or entity. Every day during which a violation occurs or continues shall be deemed a separate offense. In addition to the minimum fines provided, the city may issue a stop work order or revoke the building permit if a violation continues after warning, citation and request for compliance.
   (C)   Any contractor, installer, company or individual who violates § 151.100 shall be responsible to pay a fine of at least $75 for each offense. Each day and each property shall be considered as a separate and distinct offense.

   (D)   In addition to the penalty provided for in § 10.99 for violations of §§ 151.145 through 151.154, the city may file suit seeking the demolition, repair or enclosure of a structure, or such other relief as is provided for in state law.

   (E)   Any person who violates, disobeys, omits, neglects or refuses to comply with any of the provisions of §§ 151.066 through 151.088 shall be subject to fine in accordance with the penalty provisions of this code. There may be times when the city will incur delay or other costs, including third party claims, because the utility will not or cannot perform its duties under its permit and this chapter. Unless the utility shows that another allocation of the cost of undertaking the requested action is appropriate, the utility shall bear the city’s costs of damages and its costs of installing, maintaining, modifying, relocating or removing the facility that is the subject of the permit. No other administrative agency or commission may review or overrule a permit related cost apportionment of the city. Sanctions may be imposed upon a utility that does not pay the costs apportioned to it.
