§ 130.99 PENALTY.

   (A)   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.

   (B)   Violations of § 130.02 of this chapter shall be a Class B misdemeanor and, upon conviction, subject to penalty as provided in § 10.99 of this code of ordinances.

   (C)   (1)   Arrest, citation. Any person who is in violation of the provisions of § 130.16 of this chapter is subject to arrest and citation.

      (2)   Return to custody of parent. Any minor arrested or cited shall be returned to the custody of the parent, guardian or other person charged with the care and custody of the minor.

      (3)   Parent’s refusal to appear/take custody. It shall be unlawful for any parent, guardian or other person charged with the care and custody of a minor who is in violation of § 130.16 of this chapter to knowingly refuse to appear and take custody of such minor within a reasonable time after being ordered to do so by a peace officer.
