A. Applicability: Within the village, all work within public ways and public utility easements shall meet the requirements of and be carried out in compliance with this title and other pertinent village ordinances.
B. Permit Required: It shall be unlawful to proceed with any work within public ways and public utility easements or with any water service extension construction without first having secured a permit therefor from the village.
C. Application For Permit: Application for a permit under this title shall be on forms furnished by the village for that purpose and shall include a description of the nature and location of the work to be done and such other information as required by the village. No work shall commence until such permit has been issued by the village.
A copy of the permit issued under this title and a copy of the approved plans and specifications shall be kept at the location of the work at all times while such work is in progress.
D. Insurance Required: Each applicant for a permit required for work within public ways and public utility easements shall carry adequate liability and property damage insurance as set forth in title 1, chapter 8 of this code.
The legal liability of the permittee to the village and any person for any of the matters that are the subject of the insurance policies or self-insurance required by this section shall not be limited by such insurance policies or self-insurance or by the recovery of any amounts thereunder.
E. Village Review Of Permit Applications: Completed permit applications, containing all required documentation, shall be examined by the village engineer within a reasonable time after filing. If the application does not conform to the requirements of applicable ordinances, codes, laws, rules, and regulations, the village engineer shall reject such application in writing, stating the reasons therefor. If the village engineer is satisfied that the proposed work conforms to the requirements of this title and applicable ordinances, codes, laws, rules, and regulations, the village engineer shall issue a permit therefor as soon as practicable. In all instances, it shall be the duty of the applicant to demonstrate, to the satisfaction of the village engineer, that the construction proposed under the application shall be in full compliance with the requirements of this title.
F. Applicant's Duty To Update Information: Throughout the entire permit application review period and the construction period authorized by the permit, any amendments to information contained in a permit application shall be submitted by the permittee in writing to the village within thirty (30) days after the change necessitating the amendment.
