7-1-1005: PEDESTRIANS IN ROADWAYS:
   A.   Definitions: For the purposes of this section of the Traffic Code:
 
HIGHWAY:
The entire width between the boundary lines of every way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel (625 ILCS 5/1-126).
PEDESTRIAN:
Any person afoot, using a wheelchair or other mobility aid, or wearing in-line speed skates, including a person with a physical, hearing, or visual disability.
ROADWAY:
That portion of a highway improved, designed or ordinarily used for vehicular traffic, exclusive of the berm or shoulder (625 ILCS 5/1-179).
 
   B.   It shall be unlawful for any pedestrian to sit, stand, or otherwise remain on a roadway, except as provided for in subsection D, below.
   C.   It shall be unlawful for any pedestrian to approach any standing vehicle on a roadway for any reason, except as provided for in subsection D, below.
   D.   The following exceptions apply:
      1.   A pedestrian may approach a standing vehicle for the sole purpose of entering that vehicle as a passenger with the consent of the vehicle's driver.
      2.   A pedestrian may approach or exit a standing vehicle in cases of emergency, or in cases where the pedestrian is in danger and needs immediate assistance.
      3.   In residential subdivisions where sidewalks are not present, pedestrians may enter the roadway for otherwise lawful reasons.
      4.   Construction or utilities workers within a properly designated, closed, or segmented section of the roadway as required to perform their duties. (Ord. G-1218, 11-10-2022)
