1424.03 POWERS AND DUTIES.
   For the purpose of carrying out the intent and purpose of this Building and Housing Code, the Board of Zoning and Building Appeals shall have the following powers and perform the following duties:
   (a)   To hear any appeal, filed as provided for in this Building and Housing Code, by any person adversely affected by a decision of the Superintendent of Building and Zoning Inspection in the enforcement of this Building and Housing Code, and to determine whether, in the opinion of the Board, a decision of the Superintendent should be reversed, modified or affirmed. The Board shall have the power and authority to require, by resolution, that the Superintendent modify, reverse, or enforce his or her decision.
   (b)   To formulate and report to Council, from time to time, recommendations for action by Council upon such amendments in existing ordinances, relating to the purposes declared in Section 1420.03, as public health and safety and the development of the arts and sciences may from time to time require.
   (c)   To formulate and report to Council, from time to time, recommendations for action by Council upon such additional legislation as it may recommend with a view to carrying out fully, by ordinance, the purposes declared in Section 1420.03.
   (d)   To determine by rule or regulation, or an amendment thereto, on any application made, that any particular fixture, device, material, system or method or manner of construction may be used, whenever the use of such fixture, device, material, system or method or manner of construction is determined to be equivalent to that described in any section of this Building and Housing Code, as regards the standards and purposes of this Building and Housing Code, and is permitted by or is not prohibited by the Ohio Revised Code and the rules and regulations of the Ohio Board of Building Standards.
   (e)   To conduct such hearings, in addition to those required by this Building and Housing Code, to make or cause to be made such investigations and tests, and to require from other City departments, employees, boards and commissions such information, as the Board may deem necessary or desirable to assist in the discharge of any duty or in the exercise of any power mentioned in this section or elsewhere in this Building and Housing Code.
   (f)   In a specific case, to hear an appeal for authorization of variations in the requirements of this Building and Housing Code, where such variations are permitted to be made by the Board under the provisions of this Building and Housing Code, provided that such appeals are filed as required in Section 1424.04(b) for appealing a decision of the Superintendent.
   In matters to be acted upon by the Board, over which other departments or divisions of the City government, in addition to the Division of Building and Zoning Inspection, have jurisdiction, the director of the department or the head of the division having such jurisdiction shall be consulted before such matters are finally acted upon by the Board.
