1442.05 RESPONSIBILITIES OF PERMIT HOLDERS, OWNERS, CONTRACTORS, ETC., RE MAINTENANCE OF AREAS SURROUNDING CONSTRUCTION SITES.
   (a)   It shall be the responsibility of the permit holder to insure that the areas surrounding a construction site and the public streets used to access that site are maintained and properly protected for the health, safety and welfare of the community.
   (b)   During the time that construction, reconstruction, repair, grading or landscaping is being done on any premises within the City, the permit holder, owner, employing contractor and all persons performing work shall be responsible for the following:
      (1)   The sidewalk, treelawn area, roadway, gutters and storm drains in front of a construction site shall be kept open and free of building materials, debris and other nuisances.
      (2)   On new construction a temporary drive capable of supporting delivery trucks of building material suppliers must be installed.
      (3)   All mud, gravel, sand or other debris tracked onto the roadway must be removed as soon as possible.
      (4)   All other construction debris accumulated on a particular building site must be controlled on that site so as not to create a nuisance to surrounding properties or be distributed throughout the neighborhood.
   (c)   Whoever violates or fails to comply with any of the provisions of this section, and does not respond to a compliance order of the Building Commissioner or his or her representative, may be immediately issued a stop-work order in regard to the offending site or sites and/or be subject to the penalty provided in Section 1442.99.
