(a) No person shall engage in the business of cutting trees for timber ("timbering") purposes within the Municipality without first obtaining a permit therefor and without providing a sufficient bond in accordance with this chapter. An application for a permit shall be filed with the Building Department prior to the commencement of such timbering and shall contain the following minimum information and such other information as the Building Commissioner shall require including the information required by this chapter.
(1) Name, address, and phone number of applicant.
(2) Name, address and phone number of property owner.
(3) Address of property including permanent parcel number.
(4) Verification that owner authorized timbering on said property.
(5) Management Plan for timbering on property.
(6) Bond, where required.
(7) Proof of designated agricultural district, where applicable.
(b) Commercial Timbering. At the time of filing the application, the applicant shall pay a permit fee in the amount set forth in Chapter 214 of the Administration Code, per equivalent acre of timber determined in the plan to be cut for commercial purposes.
(1) "Equivalent acre" is defined as the number of trees cut divided by average density of trees per acre on the property.
(2) In addition to the permit fee, a surety bond in the amount of five hundred dollars ($500.00) per equivalent acre to be cut shall be provided. Such bond shall be utilized to ensure the clean up of all debris from the commercial cutting operation, as well as the final seeding.
(c) Agricultural District. The permit fee for property designated as an agricultural district pursuant to Ohio R.C. 929.02 shall be as provided for in Chapter 214 of the Administration Code. The requirement of a surety bond shall not apply to property designated as an agricultural district upon proper verification by the Building Commissioner of such status.
